Terms & Conditions
Account Registration
You must be able to enter a legally binding contract in order to register on the Site. By registering on Aces Bid, you agree to be bound by these terms and conditions and are able to register for auctions.
In order to register for an account, you must provide your full name, birth date, phone number, address, and a valid credit card number. An authorization hold of $1 will be placed on the card to ensure it is valid. Every time you register for an auction, you MUST ensure that all information provided is truthful and up to date.
Bidding
By placing a bid, you enter into a legally binding contract to purchase the lot for the bid amount and any applicable taxes and fees if you are the highest bidder. If there is a bidding error, Aces Bid must be notified immediately. If not, the bidder will be held responsible for payment of the bid. In some circumstances, it is mandatory for bidders to supply a deposit after a certain dollar amount has been attained.
Lots
Merchandise may be sold individually or in multiple quantities. Items may be removed from the auction by the seller with authorization of Aces Bid before or after the auction has concluded. The only compensation to the high bidder will come in the form of a refund of the amount paid if money has been exchanged.
Inspection Time and Equipment Condition
All equipment is being sold in an “as is, where is” condition. It is the responsibility of the bidder to view the equipment during the viewing times provided. AcesBid.com is not liable for providing the functionality, condition, or warranty status of any goods. Pictures and descriptions are supplied for the benefit of the bidder and will not be interpreted as symbols or warranties for any merchandise. Inaccuracies or incompleteness of information regarding the pieces is not the responsibility of AcesBid.com.
Auction Closing
Auction listings end at the time stated on the auction site unless they are bid on within the time frame specified in the auction terms.
Sold to Highest Bidder
All items are sold to the highest bidder unless the seller has placed a reserve on the piece. In this case the bid is subject to the seller’s confirmation. In some cases, the auctioneer may bid on behalf of the seller to protect their reserve. Disputes over the winning bid price or any other problem will be settled according to records kept by Aces Bid.
Invoicing and Payment
After an auction ends, an email will be sent to the highest bidders (“Buyers”) containing a list of items won and the total amount due including the buyer's premium stated in the auction terms, sales tax, and other fees if applicable. If an email is not received within 24 hours of auction close, call 612-743-6123. The highest bidder can also find the invoice in their account on the Site.
Any Buyer that fails to complete the transaction will be held liable for all damages resulting from that action including, but not limited to, storage costs, interest, filing fees, and attorney’s fees.
Refunds will not be given in the event of the Buyer not removing an item. It is the responsibility of the Buyer and/or their associates to ensure that all purchased items are in their possession at the close of pickup.
If the Buyer has not made arrangements for pickup two hours before the closing of auction pickup, Aces Bid reserves the right to run the credit card associated with the account in the full amount due.
Accepted Payment Methods
Aces Bid accepts payments via cashier’s check, cash, and card on the day of pickup. The only cards accepted are Mastercard, Visa, and Discover. ACES BID DOES NOT ACCEPT PERSONAL CHECKS, BUSINESS CHECKS, OR AMERICAN EXPRESS CARDS. Please make all cashier’s checks out to Aces Bid and have a valid ID when picking up. Paying with cash or cashier's check entitles the buyer to a 3% discount on the final total.
Tax Exempt Status
If you represent a tax-exempt business, you must provide an ST3 or other documentation of tax-exempt status at the time of pickup or by emailing contact@acesbid.com. Aces Bid will keep the information on file and mark your account as tax exempt until Jan 1st of the next year at which point you must provide a new ST3 form.
Removal of Equipment and Responsibilities of the Buyer
Aces Bid will provide times for the removal of equipment but will not aid in disassembling, moving, or otherwise removing equipment from the premises. The Buyer and associates take full liability for the costs incurred, hazards of disconnecting, and the removal of equipment from the auction site. It is the responsibility of the Buyer and associates to adhere to government safety laws and regulations. Responsibility for the removal of hazardous materials is the sole responsibility of the Buyer and their associates. All goods must be paid for and removed from the auction premises by the designated closing time on the last day of auction pickup. Any items still on the site after the allotted time frame will be considered abandonment. Aces Bid has the right to dispose of abandoned merchandise as it sees fit.
Acknowledgment of Auction Site Hazards
Auction sites are potentially hazardous places. Anyone entering an auction site does so at their own risk. Bidders will advise their employees etc. to use caution while entering a potentially hazardous work environment. The warning is extended to parties disconnecting or removing equipment from the site. Bidders and associates involved in preview, sale and removal at this auction are liable for all risks of injury, damage, or property loss. AcesBid.com, the seller, and the property owner are free from any and all liability.
Refusal of Access
Aces Bid reserves the right to refuse access to the site if they deem it necessary. This will be done via an account ban. If you believe the ban to be in error, contact Aces Bid by email at contact@acesbid.com. If you are found to have created a separate account after being banned, you may be subject to further restrictions including but not limited to an IP ban.
Deviation from Removal Times
The buyer may, with Aces Bid’s written permission, be able to pick up items at a later time or have items shipped to them. In order to attain permission to do so, email Aces Bid at contact@acesbid.com prior to the listed pickup date. DOING SO DOES NOT GUARANTEE A CHANGE IN REMOVAL TIME. Modifications in pickup times or location are available at Aces Bid’s sole discretion.
The buyer will be responsible for removal fees, shipping fees, and/or storage fees if applicable.
The storage fee will be in the amount of $15 per day per lot.
Declarations
There will be no declarations permitted after the goods have been dispersed from the auction site. Aces Bid is not accountable for any delivery of goods to Buyers. Aces Bid is not responsible for any acts or misconceptions occurring in conjunction with the auction.
Loss of Service
In the circumstance of an act of god, power outage, or loss of service, the auction may be determined null and void. Aces Bid is given the power to resolve the situation in whichever way they deem fit. Aces Bid is not accountable for any power loss, glitch, or loss of connection.
Agreement to Auction Terms
You agree to release Aces Bid, the seller, and the property owner from all claims and legal responsibilities. Aces Bid, the seller, and the property owner are not liable for damages, non-compliance with government laws, and any legal fees. Loss of merchandise, damage, or personal injury is not the responsibility of Aces Bid. Any bidders or parties involved in the purchasing of goods through the Site will adhere to the Jurisdiction of the MN State Courts.
Changes to Terms and Conditions
AcesBid.com (“Aces Bid”) reserves the right to change or modify any of the terms and conditions contained in this agreement or on the auction website (“the Site”). IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS OR ANY MODIFICATION, DO NOT REGISTER OR CONTINUE TO USE THIS SITE.
